33rd America’s Cup set for 12 March 2009

In his order published today, 13 May, Justice Cahn stipulated the 33rd America's Cup should take place 10 months from yesterday's final order, which means - assuming no changes are made between the two parties under the 'mutual consent' clause of the Deed of Gift – the first race will be run on Thursday 12 March 2009 with the following two races on Monday 16 March and Wednesday 18 March.
The judge's order also specifies that the SNG must inform the GGYC, of its choice of venue no later than six months before the date of the first match - by 12 September 2008 at the latest.
‘We are pleased that Justice Cahn has issued this order and recognised within his decision that it was the actions of the GGYC that brought the America's Cup to court and that depriving SNG of the 10-month notice period mandated by the Deed of Gift would be inequitable,’ commented SNG lead counsel Lucien Masmejan.
‘We are pleased that the Court has advanced the process and required the Defender to confirm the venue,’ retorted GGYC spokesman Tom Ehman. We will now be considering the order to determine our next steps, he added menacingly.
The SNG lead counsel also made it clear it still has another round to fire if necessary, insisting: ‘Several issues still remain unresolved. Among these, the GGYC certificate is critical, as it is unclear and contradictory.’
It appears the fat lady hasn’t even start warming up yet.
