Canoe hire company cleared over lake death

COURT ACTION: A canoe hire operator has been cleared of health and safety breaches over the death of a canoeist. David Proctor, who hires out canoes on Lake Vyrnwy from his firm Bethania Adventure, faced three health and safety charges following the death of 68-year-old David Phillips in 2004.

The Phillips’ hired a canoe on August 2, 2004. The canoe capsized and the couple at first clung to the upturned boat. But when the safety motorboat did not appear, they decided to try and swim for shore, even though both were poor swimmers. Mrs Phillips made it but Mr Phillips drowned.

The prosecution at Wrexham Magistrates’ Court claimed Mr Proctor had failed to point out the boundary line on Llyn Efyrnwy (Lake Vyrnwy), beyond which Mr Phillips and his wife should not paddle, says the report in the Llandudno Junction Daily Post .

The prosecution had further claimed when Mr Proctor realised they had not been spotted on a regular safety sweep by his motorboat, he failed to react swiftly enough. He was also accused of not providing a flotation device sufficient for the circumstances. After the five day trial at Wrexham Magistrates Court Mr Proctor was cleared of all charges.

Mrs Phillips, of Haddenham near Aylesbury, Buckinghamshire, left the court in tears and did not speak.

‘I have always maintained I did everything expected of me and from the time I became aware that Mr and Mrs Phillips were missing I did all I could to locate them,’ said Mr Proctor following the hearing. ‘Whilst I remain saddened by Mr Phillips’ death this verdict proves I did not fail in my duty and followed all protocols and safety procedures.’
