The ‘Who Cares Cup’

AMERICA’S CUP: After watching what used to be the greatest sailing event in history for a number of years, Portsmouth Poll says she reckons it’s time to find something else to get involved with.

The latest move in the battle of the advocates saw the Appellate Division of the New York Supreme Court vote 3-2 to overturn the lower court's original ruling on the Challenger of Record for the next series.

So we now find the hastily constructed Nautico Español de Vela (aka Ernesto Bertarelli [aka Alinghi]) back in the saddle as Challenger of Record after having been given the heave-ho a while back in favour of the Golden Gate Yacht Club (aka Larry Ellison [aka BMW Oracle]).

As expected, this latest course of action brought yet more legal actions as the GGYC submitted yet another appeal against the latest ruling. So we now have the original successful appeal overturned and another appeal lodged against that appeal (Poll thinks).

At the same time, nobody knows what’s going on. Nobody knows when - or where - the next America’s Cup will be raced.

Most of the challengers have run out of money and sponsors. Their rock star sailors are now back in the land of the normal and working at McDonalds part time to fund their habit instead of flying everywhere Business Class.

Once this latest appeal has been heard, we may have an America’s Cup date and venue agreed. But the big question will be – who cares?

On one hand we have a billionaire Ice Cream Salesman who was prepared to bend the rules to set up the next America’s Cup just the way he wants it. On the other hand we have a Software Salesman who is trying to gain access to that very privileged club by legal means when he failed to gain entry on the water.

Now we have Sir Keith Mills, head of the proposed British challenge (is it still in business, asks Poll?), offering The Royal Thames Yacht Club as Challenger of Record to get the next series going.

‘Both sides, it seems to me, need to show some statesmanship, some leadership,’ said Mr Mills. ‘Both are leading teams in the sport, and I think the time's come where they both need to give way. If Ernesto Bertarelli can be persuaded to ask CNEV to step down and Larry and Russell (Coutts) ask GGYC to step down, effectively both give up their positions, then there's a good chance they can agree.’

It’s an old trick and it might just work. Poll would like to see both Bertarelli and Ellison charged with bringing the sport into disrepute. But that would probably take too long in the courts.

And who really cares anyway?
